About Us: Method patents versus apparatus patents, what’s the story? Well, sometimes an invention is embodied in a method or process, while other times the invention is an apparatus or physical device, and often an invention is embodied in both a method/process as well as an apparatus or device. It is critical that a patent attorney has the skill of teasing out the true underlying invention and including disclosure in a patent application to support both method and apparatus claims. After all, you don’t want to be years down the road and realize that your patent application does not contain the disclosure needed to support what you are trying to protect. A patent application should be prepared from the perspective that the invention is going to be a smashing success and continuation applications will be filed for the next decade trying to protect every iteration imaginable. Do your patent applications contain meaty disclosure to support such a strategy?
